In his closing argument Wednesday, Truehope lawyer Shawn Buckley said some of the people who use EMPowerplus might be at risk of suicide, assaulting someone or being put in hospital or jail.

Buckley said when Truehope was charged, most of the natural health industry did not have DINs because their products did not contain drugs and did not qualify.

The federal government developed a system in 2004 to identify and check natural health products.

Rather then receiving a DIN, Truehope would have received a Natural Product Number, once tests of EMPowerplus had been completed.

Later that year, Truehope reached an agreement with the federal minister of health to allow the product to be sold.

Doctor Thomas Spicuzzo signed a note authorizing them to take a mid-week break.

Now, Lyn has been charged with contributing to the delinquency of a minor in the case of Jimmy.

Doctor Spicuzzo defended his order, saying even with Jimmy on some medicine, a full week of school takes its toll on him.

"He melts down literally and his behavior becomes unmanageable and uncontrollable," he said.

"I could put him in chemical handcuffs but that wouldn't serve any useful purpose; it would just make a zombie out of him." Superintendent Gary McQuain said he can not talk about the case.

He said they are required to look into a child's situation after a certain number of absences.

The case is due in court next week.
