Malaby and Salamon bite off the cagey theme of “A Melody for Her” with real gusto, and the group’s sudden, telepathic shift from a looser time into a straight 4/4 swing during Malaby’s solo emphatically undermines any claim to the band being negatively affected by underrehearsal.

Here and elsewhere, Salomon’s single-note, non-chordal lines act more like a horn than guitar, and, horn-like, he often lays out during Malaby’s solos.

While state law prohibits the prosecution of those found incompetent to stand trial, a second opinion is allowed, so Cochise County Superior Court Judge Wallace Hoggatt delayed Peleszak's competency hearing until prosecutors could do their own evaluation.

According to court records, a psychiatric evaluation presented by prosecutors agreed with the finding that Peleszak was unable to assist in her own defense due to her condition.

The judge dismissed the charge on Friday.

Tucson lawyer appointed to new Pima judgeship TUCSON - Tucson attorney Gustavo Aragon Jr.

has been appointed to a newly created judgeship in Pima County Superior Court by Gov.

Janet Napolitano.

Aragon earned his law degree from the University of Arizona in 1977 and began his career as a Treasury agent with the Internal Revenue Service.
