She sought divorce on grounds of mental and physical cruelty and her husband’s insanity.

A bench of Justice Ruma Pal and Justice AR Lakshmanan said the couple had crossed the point of no return and could never live on as husband and wife.

Moreover, they said, the wife’s stay with the husband could be injurious to her health.

Holding that the relationship had broken down irretrievably, the bench decided “to allow her appeal and relieve her from the shackles and chain of the husband”.

It said the matrimonial relationship must be seen as a whole.

Cruelty is not just physical violence but includes injurious reproaches, accusations, and taunts.

“It (cruelty) may be mental such as indifference and frigidity towards wife, denial of company to her, hatred and abhorrence for wife, or physical, like acts of violence and abstinence from sexual intercourse without reasonable cause,” the bench said.
