The lower court and Delhi High Court had dismissed her petition holding that her husband was not suffering from ba href=/schizophrenia/a/b and that there was insufficient material on record to establish the cause of cruelty. The courts had held that the incidents of cruelty were not as grave so as to be included within the scope of concept of cruelty. Setting aside the verdict of trial court and High (Court, the Bench said "the trial court failed to appreciate the uncontroverted evidence of the appellant (woman) who had proved the case on every count. "It has been established beyond doubt by the doctors who had deposed as witnesses and brought original medical record of the respondent (husband) that he is suffering from mental disorder." Holding that grant of divorce on the plea of mental insanity and mental disorder is different than cruelty, the Bench said "the appellant (woman), in our view, had proved beyond doubt that the respondent (husband) suffered from mental disorder and that the appellant suffered cruelty by and at the behest of the husband". Drug Plans Available to California Medicare Beneficiaries Often Do ......ba href=/schizophrenia/a/b; antiretrovirals, which are used to treat HIV; and antihypertensives and anti-cholesterol drugs, which are both used to treat high blood pressure and cholesterol. CMS designates antipsychotics and antiretrovirals as "protected" under the drug benefit, meaning that plans must cover "all or substantially all" available drugs (White et al., "The Medicare Drug Benefit: How Good Are the Options? " March 2006). Medi-Cal covers 20 antipsychotic medications, compared with a median of 18 medications for Medicare PDPs, according to the study. In addition, Medi-Cal covers 23 antiretrovirals, the same median as Medicare plans. Medi-Cal covers 12 blood pressure drugs and 14 cholesterol-lowering drugs, compared with a median of eight antihypertensives and 10 anti-cholesterol treatments. According to the study, "Many ... beneficiaries, even if they are properly enrolled in a drug plan, have coverage that is inferior to their coverage under Medi-Cal for the four classes analyzed" (Los Angeles Times, 3/21). Coverage by Plan The study also examines coverage under stand-alone prescription drug plans, Medicare Advantage plans and special needs plans. It looks at coverage of the 100 most commonly prescribed drugs under 10 different plans.
